This woman is a school teacher when at home in Southern Lebanon, and her husband a retired soldier. They had to leave their small town with no notice, through an intense air raid, as Israeli bombs destroyed buildings and killed and maimed people all round them. They got out only with what they could carry. Their home was destroyed behind them. Israel has targeted refugees all over Lebanon. Just the day before, we had been at the site of a refugee aid centre in central Beirut, which had been targeted for missile attack. The death toll on that attack has now risen to five, with seventeen seriously injured. |

Surely hundreds of thousands, perhaps half a million or more. The casualty figures from weapons of war are meaningless. What is the purpose of denying the means of life to an entire population, other than to eradicate that population? And what is the point of attempting to preserve a nation whose population willingly participates in such slaughter? If it has a future at all, it is only as a monstrous pariah. Im Gegenzug wurden die US-Sanktionen aufgehoben. Trump ging das nicht weit genug, weshalb er den Deal beendete und die Sanktionen wieder in Kraft setzte. Er wollte so „maximalen Druck“ auf den Iran ausüben. Rohrkrepierer: Doch das ging, wie man heute weiß, nach hinten los. | Experteneinschätzung: Der Iran ist bereits eine nukleare Macht. Das Institute for Science and International Security in Washington liefert den Beweis. Nach Berechnungen von Analysen internationaler Inspekteure geht das Institut davon aus, dass der Iran genügend angereichertes Uran gelagert hat, um „sieben Atomwaffen in einem Monat, neun in zwei Monaten, elf in drei Monaten, 12 bis 13 in vier Monaten und 13 in fünf Monaten herzustellen.“ |

| Wann, wenn nicht jetzt, sollte Netanjahu die USA an seine Seite zwingen. Mit dem Schwung des iranischen Angriffs und der legitimen Reaktion darauf ließe man der demokratischen Administration in Washington kaum eine andere Wahl. Doch Vorsicht! Der Fall ist nicht so eindeutig, wie es bisher klang, weshalb auch die israelische Regierung zögert, knallhart durchzuziehen. Drei Gründe sprechen dagegen, diesen riskanten Schritt zu wagen. 1. Angst vor weiterer Isolation: Der Iran dürfte im Falle eines solchen Frontalangriffs gegen seine militärischen Pläne ebenfalls in die Vollen gehen. Die Folgen für die israelische Zivilbevölkerung werden womöglich gravierend sein. |

Unsichere Erfolgsaussichten: Schon einmal wurden, damals unter Beteiligung des ehemaligen nationalen Sicherheitsberaters der USA, Zbigniew Brzezinski, die Chancen taxiert, die nuklearen Kapazitäten des Iran zu zerstören. Das Ergebnis war ernüchternd: Selbst ein Frontalangriff auf die nukleare Industrie des Landes würde das Projekt Atombombe nur um zwei Jahre verzögern. 3. Wie stabil ist die Freundschaft zu den USA? Kurz vor der Präsidentenwahl ist Joe Biden ein unsicherer Kantonist. Das Weiße Haus schaut anders auf den Iran, als die Regierung in Jerusalem, wie Gideon Rachman in der Financial Times präzise beschreibt: „Israel sieht den Irak als Gruppe religiöser Fanatiker, die ein Armageddon riskieren würde. Die US-Regierung sieht die iranische Regierung als brutal, aber rational.“ Fazit: Die Abwägungsprozesse von Politikern und Militärs, die in diesen Stunden stattfinden, sind in ihrer Dramatik kaum zu überbieten. More than 1,200 Israelis and foreign nationals in Israel and, as of January 4, more than 22,000 Palestinians in Gaza, the majority of them civilians, have been killed since October 7, 2023, according to local authorities, amid hostilities between Israeli forces and Palestinian armed groups in Gaza that have included unlawful attacks and other grave abuses. Meanwhile, killings, administrative detention, and settler violence against Palestinians in the occupied West Bank reached years-long highs. “The heinous crimes carried out by Israeli forces and Palestinian armed groups since October 7 are the abhorrent legacy of decades-long impunity for unlawful attacks and Israel’s systematic repression of Palestinians,” said Omar Shakir, Israel and Palestine director at Human Rights Watch. “How many more civilians must suffer or be killed as a result of war crimes before countries supplying weapons pull the plug and otherwise take action to end these atrocities?” |

| Hostages tortured to death. Parents executed in front of their children. Doctors beaten. Babies murdered. Sexual assault weaponised. No, not Hamas crimes. This is part of an ever-growing list of documented atrocities committed by Israel in the five months since 7 October – quite separate from the carpet bombing of 2.3 million Palestinians in Gaza and a famine induced by Israel’s obstruction of aid. Last week, an investigation by the Israeli newspaper Haaretz disclosed that some 27 Palestinians seized off Gaza’s streets over the past five months are known to have died during interrogations inside Israel. Some were denied medical treatment. But most are likely to have been tortured to death. Three months ago, a Haaretz editorial warned that Israeli jails “must not become execution facilities for Palestinians”. Israeli TV channels have been excitedly taking viewers on tours of detention centres, showing the appalling conditions Palestinians are kept in, as well as the psychological and physical abuse they are subjected to. An Israeli judge recently called the makeshift cages in which Palestinians are held “unsuitable for humans”. Remember, a large proportion of the 4,000 or so Palestinians taken hostage by Israel since 7 October – probably the vast majority – are civilians, like the men and boys paraded through Gaza’s streets or held in a stadium stripped of clothing before being dragged off to a dark cell in Israel. Women Abused According to Israeli media, many dozens of Palestinian women – including pregnant women – have been seized too, but in their case off camera. Presumably, Israel has wished to avoid undermining its careful messaging that only Hamas weaponises violence against women. But according to United Nations legal experts, Palestinian women are suffering the most degrading forms of abuse at the hands of the Israeli military. The experts observed that Palestinian women and girls in detention were reportedly being subjected to “multiple forms of sexual assault, such as being stripped naked and searched by male Israeli army officers. “At least two female Palestinian detainees were reportedly raped while others were reportedly threatened with rape and sexual violence.” Soldiers are also believed to have taken photos of female detainees in degrading circumstances and then uploaded them online. Palestinian women and girls in Gaza are also reported by their families to have gone missing after contact with the Israeli army. “There are disturbing reports of at least one female infant forcibly transferred by the Israeli army into Israel, and of children being separated from their parents, whose whereabouts remain unknown,” they said. Beatings, Waterboarding A separate report by the UN last week revealed that 21 of its staff – humanitarian aid workers – had been snatched by Israel. They were then tortured to extract confessions, most likely false, of involvement in Hamas’ 7 October attack. Their torture included beatings, waterboarding and threats to family members. Those confessions were cited by western allies as the grounds – in fact, the only known grounds – for cutting off funding to the UN relief agency Unrwa, the last lifeline for Gaza’s starving population. It was these claims, extracted through torture, that helped Israel rationalise its imposing of a famine on Gaza. Of the 1,000 detainees subsequently released, 29 were children, one as young as six, and 80 women. Some were reported to have cancer and chronic illnesses such as Alzheimer’s. According to the UN investigation, Palestinians reported severe punishment beatings, being caged with attack dogs, and suffering sexual assault. Biden vs. Netanjahu – und der schießt zurück

Netanjahu müsse „den unschuldigen Menschenleben mehr Aufmerksamkeit schenken, die verloren gehen“, sagte Biden. Die vielen Toten seien „das Gegenteil dessen, wofür Israel steht“, mahnte er. Netanjahu begehe einen „schweren Fehler“. Biden wurde deutlicher als deutlich: Meiner Meinung nach schadet er Israel mehr, als dass er Israel hilft. “ Netanjahu zeigt sich unbeeindruckt: Im Interview mit BILD-Vize Paul Ronzheimer holte der israelische Regierungschef gestern Abend zum Gegenschlag aus. Man sei dem Sieg „sehr nahe“. „Sobald wir mit der Militäraktion gegen die verbliebenen Terroristenbataillone in Rafah beginnen, ist es eine Frage von Wochen, bis die intensive Phase der Kämpfe“ abgeschlossen sei, erklärte er. Affront gegen Biden? Den Vorwurf, Israel würde zu wenig für die Zivilisten im Gazastreifen tun, wies er zurück. Es sei die Politik Israels, „so viel humanitäre Hilfe wie möglich bereitzustellen“. Für die prekäre Lage der Bevölkerung sei die Hamas selbst verantwortlich. Und dann wird Netanjahu persönlich: Den Plan, die Bevölkerung im Gazastreifen über den Seeweg mit Hilfsgütern zu versorgen, beansprucht der israelische Ministerpräsident für sich. Schon „zwei Wochen nach Kriegsbeginn“ habe er in einem Telefonat mit Joe Biden „eine Seeroute von Zypern“ vorgeschlagen, sagte er. |
| Im Amerikanischen gibt es die wunderbare Redewendung: „If the man meets the moment.”Damit ist gemeint: Jemand wächst in historischer Stunde zu übernatürlicher Größe auf. Der Unternehmer Oskar Schindler zum Beispiel, als er in der Nazizeit 1.200 bei ihm beschäftigte Juden vor der Deportation rettete. Oder Bundeskanzler Willy Brandt, als er beim Besuch des Warschauer Ghettos spontan auf die Knie sank. |
| Der Moment hat diese Menschen nicht erniedrigt, sondern erhoben. Er hat sie größer gemacht, als sie vorher waren. So wurden sie vor aller Augen, um eine weitere amerikanische Redewendung zu zitieren, zum „bigger than life character“. |
| Der Fall Benjamin Netanjahu. Hierbeobachten wir das Gegenteil. Ein Mann verpasst seinen Moment. In der Stunde der Herausforderung wächst er nicht, sondern er schrumpft. Er ist ein Opfer des Terrors und wird nun für viele Zivilisten zum Täter. Er beantwortet Gewalt mit Gewalt und hat offensichtlich keine tragfähige Idee von der näheren Zukunft seines leidgeprüften israelischen Staates. |
| Mit Israel ist nichts falsch. Das Land hat das historische, moralische und daher unveräußerliche Recht, als Nation zu existieren und zu prosperieren. Als einzige funktionierende Demokratie in einer Region der Despoten ist dieser Staat eine Inspiration für viele.Doch irgendwas ist falsch mit Benjamin Netanjahu. Menschlich und politisch. Der frühere Generalstabschef Gadi Eisenkot, ein Oppositionspolitiker, der mittlerweile dem Kriegskabinett angehört, sieht die „scharfe und klare“ Verantwortung des Premiers für den 7. Oktober.Netanjahu ignorierte die Warnungen, sodass die Terrororganisation ohne Gegenwehr ihren Anschlag auf die Menschlichkeit verüben konnte. Diese Schläfrigkeit versucht der Regierungschef seither, mit einer Politik der eisernen Hand vergessen zu machen.# 2 Netanjahu hat mit Joe Biden gebrochen: Mit seiner militärischen Überreaktion riskiert er die Freundschaft mit dem amerikanischen Establishment. | Der amerikanische Präsident kritisiert. In seinen Reden fokussiert Biden nicht mehr allein auf das Existenzrecht Israels, das es zu verteidigen gelte.In den Mittelpunkt rückt zunehmend die rücksichtslose Form der Kriegsführung in einer von Zivilisten bewohnten Stadt. „Netanjahu muss den unschuldigen Menschenleben mehr Aufmerksamkeit schenken, die verloren gehen“, sagt Biden. |
| Die Opfer: Über 31.000 Menschen seien in dem Krieg gemäß Angaben des Gesundheitsministeriums von Gaza ums Leben gekommen, zitiert Biden. „Das ist das Gegenteil dessen, wofür Israel steht.“ Eine Offensive auf die Stadt Rafah, wo mehr als eine Million Menschen vor dem Krieg Zuflucht suchen, nennt Biden eine „rote Linie“. |
| # 3 Netanjahu bringt die Deutschen gegen sich auf: Auch im Nachkriegsdeutschland, das die Freundschaft zu Israel zur Staatsräson erklärte, wächst die Distanz zum israelischen Regierungschef. |

| Die Mehrheitsmeinung im Kabinett: Der Kanzler bleibt zurückhaltend mit seiner Kritik, derweil Vizekanzler Robert Habeck bei seinem Amerikabesuch deutliche Töne anschlägt: |
| Das heißt nicht, dass sie die Hamas nicht bekämpfen müssen. Aber die Zahl der zivilen Opfer ist zu hoch und die Strategie muss geändert werden. “ |
| # 4 Netanjahu will die Weltgemeinschaft nicht beruhigen, sondern aufpeitschen:Der Kritisierte selbst tut nichts, um die Kritiker zu besänftigen. |
| Im Gegenteil. Er nutzt jede Minute zur weiteren Polarisierung. So hat Israels Regierungschef mit einer vor der Vollversammlung der Vereinten Nationen gezeigten Israel-Karte, die kurzerhand auch die palästinensischen Gebiete miteinschloss, die Gemüter erregt. Der Leiter der Palästinensischen Mission in Deutschland, Laith Arafeh, schrieb auf X: |
| Es gibt keine größere Beleidigung als eine Landkarte zu zeigen, die Palästina und sein Volk negiert. “ |
| Gegenüber Joe Biden, der den geplanten Angriff auf Rafah eine „rote Linie“ nennt, sagt Netanjahu: |
| Wir werden dorthin gehen. Wir werden sie nicht allein lassen. Wissen Sie, ich habe eine rote Linie. Wissen Sie, was die rote Linie ist? Dass der 7. Oktober nicht wieder passiert. “ |
| # 5 Netanjahu sagt Hamas und führt Krieg auch auf Kosten der Zivilbevölkerung: Die Jagd auf die Terrororganisation und ihre Kämpfer wird nicht als Polizeioperation, sondern als militärische Intervention durchgeführt. |
| Fakt ist: Ganze Wohngebiete macht die israelische Armee auf der Jagd nach den Hintermännern des Überfalls dem Erdboden gleich. Das Leiden und das Sterben der Zivilbevölkerung wird als Kollateralschaden in Kauf genommen – auch von der Hamas, die Menschen als Schutzschilde benutzt. |
| Insgesamt meldet die Gesundheitsbehörde in Gaza, die als Teil der Hamas gilt, über 31.112 tote Palästinenser, davon mindestens 9.000 Frauen und 13.000 Kinder. 1,7 Millionen Menschen, also 75 Prozent der Bevölkerung des Gazastreifens, mussten ihr Zuhause verlassen.Die israelische Regierung bestreitet die Höhe dieser Zahlen. Die amerikanische Regierung sowie die UN halten sie für glaubwürdig. Joe Biden nutzt sie ebenfalls in seiner Kommunikation. |
| # 6 Netanjahu besitzt keine Idee für die Zeit nach dem Krieg: Die bisherige Sicherheitsdoktrin des Staates Israel hat versagt. Diese Doktrin gab das Ziel eines Ausgleichs mit den Palästinensern vor langer Zeit bereits auf und setzte stattdessen auf den Bau von Mauern und die Nutzung von Hochtechnologie, um Raketenangriffe abzuwehren. |
| Die Mauer und der martialische Grenzstreifen haben den Überfall der Hamas nicht verhindern können. Auch der Iron Dome, das automatische Raketenabwehrsystem, kam unter Dauerbeschuss an seine Grenzen. Der Economist schreibt: |
| Israels Doktrin funktioniert nicht mehr. “ |
| Fazit: Deshalb funktioniert auch Netanjahu nicht mehr. Er versteht Politik als das Wechselspiel von Aggression und Gegenaggression, Erstschlag und Revanche. In seinem Einzugsbereich gilt der alte Stalin-Satz: |
| Und willst du nicht mein Bruder sein, so schlag ich dir die Fresse ein. “ |
Vernichtungsfeldzug gegen die Palästinenser
Friedrich Merz steht eisern an der Seite der auf Rafah im südlichen Gazastreifen vorrückenden israelischen Truppen – und damit auf der falschen Seite der Gegenwartsgeschichte. Die Selbstverteidigung des Staates Israel nach dem Überfall der Hamas gerät zum Vernichtungsfeldzug gegen die Palästinenser – und der deutsche Oppositionsführer trägt mitleidslos die alten Sprechzettel vor.
Wenn es jetzt darum gehe, „den Terror im Gazastreifen endgültig zu besiegen, dann wird das nicht ohne Opfer in der Zivilbevölkerung gehen können“, sagte er vor Ort in die Kamera von WELT TV. Er habe großes Verständnis dafür, „dass die israelische Regierung und die israelische Armee jetzt sagen: Wir wollen nie wieder diesen Terror aus dem Gazastreifen gegen den Staat Israel sehen.“

| Die Menschenrechte sieht er durch das Vorgehen der israelischen Armee gewahrt: |

| Diese Kaltschnäuzigkeit gegenüber den Zivilisten und die Unempfindsamkeit für die veränderte internationale Wahrnehmung hat Friedrich Merz exklusiv. Die Weltgemeinschaft und auch die engsten Freunde der Israelis haben – nachdem weite Teile des Gazastreifens dem Erdboden gleichgemacht wurden – ihre Position nachjustiert. |
- Seit dem 7. Oktober 2023 wurden nach Angaben des Gesundheitsministeriums in Gaza mindestens 28.473 Palästinenser getötet und 68.146 Palästinenser verletzt.
- Etwa 75 Prozent der 2,3 Millionen Einwohner des Gazastreifens sind laut den Vereinten Nationen vertrieben worden.
- Rund 400.000 Menschen leiden aufgrund der von Israel verhängten Blockade des Gazastreifens und der strengen Beschränkungen für die LKW der humanitären Hilfe an Hunger.

Joe Biden war von Anfang an auf der vorsichtigen Seite. Er sagte öffentlich an die Adresse von Netanjahu: „Ich warne Sie davor, sich von dieser Wut verzehren zu lassen, auch wenn Sie sie spüren.”
Heute klingt Joe Biden entschlossener, sieht, dass seine Befürchtungen eingetreten sind: Der Militäreinsatz in Gaza sei „übertrieben“. Vor vier Monaten habe „der Großteil der Welt“ noch hinter Israel gestanden, „aber sie sind dabei, diese Unterstützung durch die willkürlichen Bombardements zu verlieren.“
| UN-Generalsekretär António Guterres sprach schon vor drei Monaten von einer „klaren Verletzung des Völkerrechts“. Damals wurde er noch angefeindet oder doch zumindest von den Freunden Israels misstrauisch beäugt. Dabei sah er schon damals, was in diesen Tagen geschieht: |
| Der Schutz der Zivilbevölkerung bedeutet nicht, mehr als eine Million Menschen zur Evakuierung in den Süden zu befehlen, wo es keine Unterkünfte, keine Nahrung, kein Wasser, keine Medikamente und keinen Treibstoff gibt, und dann den Süden selbst weiter zu bombardieren. “ |
In Deutschland hat sich das Blatt ebenfalls gewendet. Israels Sicherheit ist seit den Gräueltaten des Dritten Reichs zurecht deutsche Staatsräson. Damit einhergehend auch die bedingungslose Solidarität: „In diesen Tagen sind wir alle Israelis“, sagte Außenministerin Baerbock sechs Tage nach den Angriffen der Hamas.
| Doch mittlerweile änderte sich der Ton der Außenministerin. Inzwischen mahnt sie Israel zur Zurückhaltung bei militärischen Angriffen auf die Stadt Rafah. Es gebe das Recht auf Selbstverteidigung, aber nicht das Recht auf Vertreibung der Zivilbevölkerung, sagte sie in dieser Woche. Auf X schrieb sie: |
| Die Not in Rafah ist schon jetzt unfassbar. 1,3 Millionen Menschen suchen dort auf engstem Raum Schutz vor den Kämpfen. Eine Offensive der israelischen Armee auf Rafah wäre eine humanitäre Katastrophe mit Ansage. Die Menschen in Gaza können sich nicht in Luft auflösen. “ |
| In Italien ist ebenfalls ein Wechsel der Tonalität zu vernehmen. Als der italienische stellvertretende Premierminister und Außenminister Antonio Tajani wenige Tage nach dem Angriff auf Israel in Tel Aviv eintraf, knüpfte er seine Solidaritätsbekundungen an die Hoffnung einer verhältnismäßigen Reaktion: |

| Inzwischen bewertet Tajani Israels Vorgehen im Gazastreifen als „unverhältnismäßig“. Im italienischen Sender Radio 1 sagt er: |
| Es gibt zu viele Opfer, die überhaupt nichts mit der Hamas zu tun haben. “ |
| Mittlerweile hat sich das niederländische Appellationsgericht in Den Haag in den Nahost-Konflikt eingeschaltet. Die Niederlande dürfen auf Geheiß der Richter vom Luftwaffenstützpunkt Woensdrecht keine Ersatzteile mehr für den Kampfjet F-35 nach Israel liefern. „Die Angriffe Israels haben eine unverhältnismäßige Anzahl Opfer gefordert, unter ihnen Tausende von Kindern“, schreibt das Gericht. |
Der einzige, der neben dem Eisernen Friedrich steht und den Krieg gegen die Hamas in aller Totalität fortführen möchte, ist Netanjahu selbst. Er hat versprochen, die Hamas mit einem „totalen Sieg“ zu „zerstören“ und weist die westliche Kritik an seiner Kriegsführung zurück.
Einen palästinensischen Staat lehnt er ab. Er folgt der traditionellen Sicherheitsstrategie des modernen Israels, die oft mit den Worten „mowing the grass and taking out the trash“ beschrieben wird. Man wollte nicht die Lösung des Palästinenserkonflikts, sondern dessen Eindämmung.
Fazit: Ex-Ministerpräsident Bennett, der seine Karriere als Netanjahus Adjutant begann, nannte den Palästinakonflikt einst den „Granatsplitter im Hintern“ („Shrapnel in the butt“) Israels. Daraus wurde das Netanjahu-Konzept „Prosper without peace“, „Wohlstand ohne Frieden“, wie es Aluf Benn, Chefredakteur von Haaretz, beschreibt. Dieses Konzept ist jetzt gescheitert. Israel leidet nicht an einem Granatsplitter, sondern an Herzrhythmusstörungen. Im Westen – minus Friedrich Merz – ist man der Meinung: Der Staat Israel soll weiterleben, aber nicht so wie bisher.
Krieg statt Frieden. Vertreibung und Verfolgung statt Zusammenleben.

| Die 1.200 Toten und über 200 Geiseln hat er indirekt mit zu verantworten. Er ist nicht der Täter, wohl aber der Hofhund, der eingenickt war. Erst so konnten die Täter eindringen. | Allerdings bewegt sich auch ein deutscher Kanzler nicht allein im Raum historisch begründeter Verantwortlichkeit. In seiner eigenen Partei und beim grünen Koalitionspartner brodelt es. Die humanitäre Katastrophe im Süden des Gazastreifens, die bisherige und die angekündigte, haben mit Annalena Baerbock eine Gegenspielerin auf den Plan gerufen. Sie will jetzt nicht artig, sie will deutlich sein: |

| Doch der 66-jährige Scholz findet nicht zum richtigen Ton. Ihm fehlt die Entschlossenheit seiner Außenministerin. Die humanitäre Lage im Gazastreifen nennt er mit väterlicher Milde „sehr besorgniserregend“.Scholz kämpft nicht für Netanjahu und nicht gegen die Hamas, sondern für sein Überleben und gegen ein Deutschland, das seiner überdrüssig geworden ist. Das Leise und Moderate, das Unentschiedene und Verdruckste seiner politischen Natur beleuchtet in dieser zugespitzten Weltlage einen Mann ohne Eigenschaften. Er ist im Westen der Staatsfeind Nr. 1 und in weiten Teilen der muslimischen Welt ein Volksheld. Sein Kriegsziel ist der Krieg.Er hasst Kompromisse, Waffenstillstände und Friedensverträge. Er will Israel nicht besänftigen, sondern liquidieren. Von den Geheimdiensten der USA wurde er bereits 2015 als „Specially Designated Global Terrorist“ eingestuft.Das Existenzrecht des Staates Israel wird von ihm nicht nur bestritten, sondern bekämpft. | Der im Dezember zum dritten Mal wiedergewählte Präsident von Ägypten, Abd al-Fattah as-Sisi, könnte die humanitäre Katastrophe in Gaza verhindern, aber er will derzeit nicht. Sein Land bleibt für sie verschlossen. Al-Sisi entsendet Hilfsgüter in den Gazastreifen, das schon. Aber einen sicheren Hafen für fliehende Palästinenser möchte er nicht bieten.Palästina ist für al-Sisi ein wichtiger Puffer zwischen Ägypten und Israel. Sollten zu viele der Palästinenser fliehen, ist die Autonomie des Gebiets gefährdet und somit die relative Sicherheit an der nordöstlichen Grenze Ägyptens. Außerdem hat er Angst, sich an einer offenen Grenze mit dem Terror zu infizieren. Seine Liebe zu den Palästinensern ist platonisch. Er will, dass sie leben, aber nicht in seinem Bett.Fazit: Die palästinensische Zivilbevölkerung hat in diesem Machtpoker keine Stimme, aber sehr wohl einen Platz. Sie hockt fröstelnd in der Mitte des Spieltisches. Sie ist der Wetteinsatz der Mächtigen. Absehbar, dass es für sie ähnlich ausgeht wie der Vietnamkrieg für die Vietnamesen. ISRAEL MUSS IGH-URTEIL UMSETZEN UND ALLES TUN, UM EINEN VÖLKERMORD AN DEN PALÄSTINENSER*INNEN IM GAZASTREIFEN ZU VERHINDERN
Urteilsverkündung im Völkermordprozess gegen Israel vor dem Internationalen Gerichtshof in Den Haag (26. Januar 2024)

Als Reaktion auf die Völkermordklage Südafrikas gegen Israel hat der Internationale Gerichtshof (IGH) am 26. Januar vorläufige Maßnahmen angeordnet. Dies könnte dazu beitragen, die palästinensische Bevölkerung im besetzten Gazastreifen vor weiterem Leid und irreparablen Schäden zu bewahren.
Der IGH ordnete in seinem Urteil sechs vorläufige Maßnahmen an: Dazu gehören die Aufforderung an Israel, Handlungen im Sinne der UN-Völkermordkonvention zu unterlassen, die direkte und öffentliche Aufstachelung zum Völkermord zu verhindern und zu bestrafen sowie sofortige und wirksame Maßnahmen zu ergreifen, um die Bereitstellung humanitärer Hilfe für die Zivilbevölkerung in Gaza zu gewährleisten. Das Gericht wies Israel außerdem an, mögliche Beweise für Verbrechen im Sinne der UN-Völkermordkonvention zu dokumentieren und dem Gericht innerhalb eines Monats einen Bericht über alle Maßnahmen vorzulegen, die im Einklang mit seiner Anordnung getroffen wurden.
„Die heutige Entscheidung ist eine kraftvolle Erinnerung an die entscheidende Rolle des Völkerrechts bei der Verhinderung von Völkermord und dem Schutz aller Betroffenen vor Gräueltaten. Diese Entscheidung macht deutlich, dass die Welt nicht schweigend zusehen wird, wie Israel eine rücksichtslose Militäraktion zur Dezimierung der Bevölkerung des Gazastreifens durchführt und Tod, Schrecken und Leid über die Palästinenser*innen in einem noch nie dagewesenen Ausmaß bringt“, sagte Agnès Callamard, die internationale Generalsekretärin von Amnesty International.
„Die Entscheidung des IGH allein kann jedoch den Gräueltaten und der Verwüstung, die die Menschen im Gazastreifen erleben, kein Ende setzen. Die alarmierenden Anzeichen für einen Völkermord in Gaza und Israels eklatante Missachtung des Völkerrechts machen deutlich, dass es dringend notwendig ist, wirksamen und einheitlichen Druck auf Israel auszuüben, damit es sein militärisches Vorgehen gegen die Palästinenser* innen einstellt. Ein sofortiger Waffenstillstand aller Parteien ist nach wie vor unerlässlich und – auch wenn er nicht vom Gerichtshof angeordnet wurde – die wirksamste Voraussetzung für die Umsetzung der vorläufigen Maßnahmen und die Beendigung des beispiellosen Leidens der Zivilbevölkerung.
Die vorläufigen Maßnahmen des IGH zeigen, dass nach Ansicht des Gerichtshofs das Überleben der palästinensischen Bevölkerung in Gaza gefährdet ist. Die israelische Regierung muss dem Urteil des IGH unverzüglich nachkommen. Alle Staaten – auch diejenigen, die Südafrikas Einreichung der Völkermordklage kritisch gegenüberstanden oder sich ihr widersetzten – haben die Pflicht, dafür zu sorgen, dass diese Maßnahmen umgesetzt werden. Die Staats- und Regierungschef*innen der USA, Großbritanniens, Deutschlands und anderer EU-Staaten müssen zeigen, , dass sie die rechtsverbindliche Entscheidung des Gerichtshofs respektieren und alles in ihrer Macht Stehende tun, um ihrer Verpflichtung zur Verhinderung von Völkermord nachzukommen. Tun sie dies nicht, wäre das ein schwerer Schlag für die Glaubwürdigkeit und das Vertrauen in die internationale Rechtsordnung.“
Die Staaten müssen auch dringend Maßnahmen ergreifen, um anhaltende Völkerrechtsverbrechen zu verhindern, unter anderem durch ein umfassendes Waffenembargo gegen Israel und bewaffnete palästinensische Gruppen.
Amnesty International hat vor der Gefahr eines Völkermords im Gazastreifen gewarnt: Die schockierend hohe Zahl der Todesopfer unter den Palästinenser*innen, die weitreichenden Zerstörungen durch Israels fortgesetzte Bombardierungen und die vorsätzliche Verweigerung humanitärer Hilfe im Rahmen der anhaltenden rechtswidrigen Blockade fügen der Zivilbevölkerung des Gazastreifens entsetzliches Leid zu. Weitere Warnzeichen sind die zunehmende rassistische und entmenschlichende Rhetorik einiger israelischer Regierungsvertreter*innen, einschließlich des Ministerpräsidenten Benjamin Netanjahu, sowie die langanhaltende Unterdrückung und Diskriminierung der Palästinenser*innen im Rahmen des von Israel etablierten Systems der Apartheid. Angesichts der ernsthaften Gefahr eines Völkermordes sind alle Staaten nach dem Völkerrecht verpflichtet, Maßnahmen zu ergreifen, um die Begehung eines Völkermordes zu verhindern.
Mehr als 26.000 Palästinenser*innen, zumeist Zivilpersonen, sind bei Bombardierungen des Gazastreifens durch die israelische Armee getötet worden. Es wird davon ausgegangen, dass noch etwa 10.000 Menschen unter den Trümmern liegen. Mindestens 1,8 Millionen Palästinenser*innen wurden vertrieben und haben keinen Zugang zu angemessener Nahrung, Wasser, Unterkünften, sanitären Einrichtungen und medizinischer Versorgung.
Amnesty International fordert Israel, die Hamas und andere bewaffnete palästinensische Gruppen auf, alle militärischen Operationen im Gazastreifen sofort einzustellen. Israel muss seine rechtswidrige und unmenschliche Belagerung aufheben und die ungehinderte und bedingungslose Lieferung von dringend benötigter humanitärer Hilfe an die palästinensische Bevölkerung ermöglichen, die unter einer vorsätzlich herbeigeführten Hungersnot leiden. Amnesty fordert die Hamas und andere bewaffnete palästinensische Gruppen auf, alle verbleibenden zivilen Geiseln freizulassen.
Hintergrund
Am 29. Dezember 2023 erhob Südafrika beim IGH Klage gegen Israel gemäß der Konvention über die Verhütung und Bestrafung des Völkermordes wegen des Vorwurfs des Völkermordes am palästinensischen Volk nach den Angriffen der Hamas und anderer bewaffneter Gruppen vom 7. Oktober 2023. Bei den Angriffen wurden fast 1.200 Menschen, überwiegend Zivilpersonen, in Israel getötet und etwa 240 als Geiseln genommen. Die Anhörungen zum Antrag Südafrikas auf vorläufige Maßnahmen fanden am 11. und 12. Januar 2024 in Den Haag statt.
In dem 84-seitigen Antrag Südafrikas werden Israel Handlungen und Unterlassungen vorgeworfen, die „völkermörderischen Charakter haben, da sie mit der erforderlichen spezifischen Absicht begangen wurden, die Palästinenser*innen im Gazastreifen als Teil der größeren palästinensischen nationalen, […] und ethnischen Gruppe zu vernichten“.
Der Internationale Gerichtshof ist das wichtigste Rechtsorgan der Vereinten Nationen. Er verfolgt nicht die strafrechtliche Verantwortung einzelner Personen, sondern hat vielmehr die Aufgabe, im Einklang mit dem Völkerrecht Rechtsstreitigkeiten zu schlichten, die ihm von Staaten vorgelegt werden, einschließlich solcher, die die Auslegung, Anwendung oder Erfüllung der UN-Völkermordkonvention und die Verantwortung eines Staates für Völkermord betreffen.
Artikel 94 der UN-Charta sieht vor, dass die Urteile des IGH für die Streitparteien verbindlich sind und dass im Falle ihrer Nichtdurchführung der Sicherheitsrat angerufen werden kann, der Empfehlungen aussprechen oder Maßnahmen beschließen kann, die zur Durchführung des Urteils zu treffen sind.
